Welcome to Brionti. These Terms of Service ("Terms") govern your access to and use of our store (the "Site") and any purchase you make through it. The Site is operated by DriveDream Limited ("Brionti", "we", "us", or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.

1. Order Process

The items you purchase are sold directly by DriveDream Limited (Brionti) to you. You provide your payment information, shipping address, and any additional required information directly to us for processing your payment and completing your order. An order is an offer to buy; a contract of sale is formed only when we accept your order and dispatch the goods. Our order-confirmation email acknowledges receipt but does not by itself constitute acceptance.

2. Conditions of Use

Your order and your use of the Site are subject to these Terms, our Privacy Policy, and any relevant terms imposed by applicable third parties, including any party supplying the products. By completing your purchase, you confirm that you have read and agree to be bound by all of these Terms.

3. Eligibility

You must be able to form a legally binding contract to use the Site. If you are under the age of majority in your jurisdiction, the approval of a parent or guardian is required to complete your purchase.

4. Account Terms

You may create an account to check out faster and manage your orders. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate, current, and complete information. We may suspend or terminate an account we reasonably believe has been used in breach of these Terms or for fraudulent activity.

5. Products, Descriptions, Pricing and Availability

We take care to describe and display our products accurately (for example "18K gold-plated brass", "S925 sterling silver", "water-safe stainless steel", "lab-created moissanite"); however, we do not warrant that descriptions, colours, or images are error-free, and actual colours may vary slightly due to photography, screens, and light source. Prices are displayed in US Dollars (USD) unless otherwise stated at checkout, and may change at any time before an order is placed. If there is a pricing error, we may contact you, correct the price, and/or cancel your order. All products are subject to availability.

6. Payment and Verification

You are purchasing from, and providing your information to, DriveDream Limited (Brionti). We are entitled to verify and authenticate your payment information, and may contact you and/or your card issuer to confirm your identity or intent. We may refuse service, refuse to process orders, or cancel orders at our reasonable discretion.

7. Shipping and Fulfilment

Shipping and delivery are governed by our Shipping Policy, which forms part of these Terms. Where an order contains multiple items, it may be fulfilled in one or more shipments; you will only be charged for the items actually fulfilled.

8. Returns, Refunds and Warranty

Returns, exchanges, and refunds are handled in accordance with our Refund & Return Policy, which forms part of these Terms. If your item arrives damaged, defective, or incorrect, please contact us within 10 days of delivery so we can review your claim. Your statutory consumer rights remain unaffected.

9. Acceptable Use

You agree not to use the Site to breach any law; to infringe our or any third party's rights; to transmit malware or attempt unauthorised access; to collect data about other users; or to place fraudulent orders or use the Site for any unlawful or abusive purpose.

10. Chargebacks, Fraud Prevention and Void Transactions

We may use industry-standard fraud-prevention and verification systems, including card authentication and address verification. If a transaction's authorisation is declined but processed due to a systemic error, that transaction will be void. For questions about chargebacks, contact support@brionti.com.

11. Intellectual Property

All content on the Site is owned by DriveDream Limited (Brionti) or its licensors and is protected by applicable copyright and trademark laws. Such content may not be used without our prior written authorisation.

12. Third-Party Links and Services

The Site may contain links to third-party websites or services that we do not control. We are not responsible for their content, policies, or practices, and access is at your own risk.

13. Disclaimer of Warranties

Except as expressly provided in these Terms or required by applicable law, the Site and products are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in this section limits your statutory consumer rights.

14. Limitation of Liability

To the maximum extent permitted by law, DriveDream Limited (Brionti) shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless DriveDream Limited (Brionti) and its officers, directors, and employees from any claims, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.

16. Currency and Billing

Prices are displayed in USD unless otherwise indicated at checkout. If your bank settles in a different currency, the final amount charged may differ due to exchange rates or fees applied by your financial institution.

17. Electronic Communications

When you place an order you communicate with us electronically, and you consent to receiving communications from us electronically, and agree that such communications satisfy any legal requirement that they be in writing.

18. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, public-health events, strikes, carrier or supplier failures, customs delays, or interruptions to power or communications.

19. Modifications to These Terms

We may update our system, policies, and these Terms at any time. The current version applies to each order at the time it is placed.

20. Assignment

You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.

21. Severability

If any part of these Terms is found invalid, that part will be severed and will not affect the validity of the remaining Terms.

22. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and us and supersede any prior agreements.

23. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law provisions.

24. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be subject to the courts of the Hong Kong Special Administrative Region.

25. Language

This agreement and all related documents are drawn up in English.
